Article 1: Definitions
For the purposes of these Terms of Use, the following definitions apply:
- Content: All elements made available on Knoowpedia, including the platform’s layout, logos, trademarks, and interactive features.
- Terms of Use: The set of regulations and guidelines governing the use of Knoowpedia.
- Intellectual Property Rights: Ownership rights relating to creative and proprietary content, including copyrights, trademarks, patents, and trade names.
- Platform: The Knoowpedia website and its associated pages where users can upload, purchase, and access academic materials.
- Profile: A personal or institutional account created by users to access and manage their activities on Knoowpedia.
- Study Materials: Any academic resources, such as notes, summaries, or research papers, uploaded by users for sharing or sale.
- Service Fees: The charges applied for platform usage and transaction processing, as outlined on Knoowpedia.
Article 2: Applicability
- 2.1 Applicability: These Terms of Use govern the rights and responsibilities of all users who access and utilize the Knoowpedia platform. By using the platform, users agree to comply with these terms.
- 2.2 Modifications and Updates: Knoowpedia reserves the right to amend or update these Terms of Use at any time. Any changes will be communicated through the platform or upon login. Continued use of Knoowpedia after updates indicates the user’s acceptance of the revised terms.
- 2.3 Disagreement with Changes: If a user does not agree with the revised Terms of Use, they must immediately stop using the platform and delete their profile. Knoowpedia is not responsible for users who continue to use the platform while disregarding these changes.
Article 3: User Accounts
- 3.1 Account Creation: To fully access Knoowpedia, users must create an account by providing accurate and complete information. Each user is responsible for ensuring that the information submitted during registration remains truthful and up to date. Incorrect or misleading information may result in restricted access or account termination.
- 3.2 Age Requirement: Users must be at least sixteen (16) years old to create an account. If a user is under sixteen, they must obtain explicit permission from a parent or legal guardian. By accepting these Terms of Use, the user confirms they are either 16 or older or have obtained the necessary consent.
- 3.3 Account Security and Confidentiality: Users are responsible for maintaining the confidentiality of their login credentials, including usernames and passwords. Sharing account details with third parties is strictly prohibited. Any actions performed through a user’s account will be attributed to the account holder. If unauthorized access is suspected, the user must take immediate action by changing their password and notifying Knoowpedia.
- 3.4 Account Modification or Restriction: Knoowpedia reserves the right to modify, restrict, or suspend user accounts as necessary to maintain platform security and operational integrity. If changes are made to the platform’s user policies, users will be notified, and continued use signifies acceptance of those changes.
- 3.5 Privacy and Data Handling: Any data provided during account registration will be securely stored and handled according to Knoowpedia’s Privacy Policy. By creating an account, users grant Knoowpedia permission to display basic profile details, such as usernames and profile pictures, for platform functionality.
- 3.6 Termination of Account: If a user disagrees with any modifications or policy changes, they may discontinue using Knoowpedia and request account deletion. Deleting an account will result in the removal of user-submitted study materials, but Knoowpedia reserves the right to retain certain data for legal or operational purposes.
- 3.7 Liability for Unauthorized Access: Knoowpedia is not responsible for any damages resulting from unauthorized access to user accounts due to negligence, such as weak passwords or failure to secure login credentials. Users are encouraged to use strong passwords and enable additional security measures when available.
Article 4: Platform Features
- 4.1 Knoowpedia as a Platform: Knoowpedia operates as an intermediary platform that enables users to upload, share, and access academic content. The platform itself does not create, review, or verify the accuracy of the study materials uploaded by users. All materials shared on Knoowpedia are the sole responsibility of the respective users who upload them.
- 4.2 No Guarantee of Content Accuracy: Users acknowledge that Knoowpedia provides its services on an "as is" basis, meaning the platform does not guarantee the correctness, completeness, or reliability of the content available. Users are encouraged to independently verify any academic materials they access and should not rely solely on the information provided on the platform.
- 4.3 Platform Functionality and Limitations: Knoowpedia strives to provide a seamless user experience, but it does not warrant that the platform will always function without interruptions, errors, or security vulnerabilities. Temporary outages, maintenance, and unforeseen technical issues may occur. Knoowpedia will make reasonable efforts to maintain platform stability but cannot be held liable for disruptions.
- 4.4 User Responsibility: Users are fully responsible for their interactions on Knoowpedia, including uploading, downloading, and sharing content. Knoowpedia is not liable for any disputes, inaccuracies, or damages resulting from the use of materials on the platform.
- 4.5 No Legal or Academic Endorsement: Knoowpedia does not provide any academic certification or legal endorsement of the materials shared on its platform. Users should consult relevant academic institutions or legal professionals if they require official verification of any study materials.
Article 5: Uploading Study Materials
- 5.1 Uploading and Sharing Materials: Knoowpedia allows users to upload study materials, which may be shared either for free or for sale. Users have full control over their content, including setting a price or offering documents at no cost. The user profile will display all uploaded materials and their respective pricing.
- 5.2 Accepted Formats and Uploading Process: Study materials must be uploaded in formats specified by Knoowpedia, which may include PDFs only or others as seen fit. Users are responsible for ensuring that their files are correctly formatted and properly uploaded. Knoowpedia does not alter or modify the content of the uploaded documents unless explicitly stated.
- 5.3 Intellectual Property Compliance: Users must ensure that their uploaded materials comply with all applicable intellectual property laws and do not infringe on third-party rights. By uploading content, users confirm that they either own the rights to the materials or have obtained the necessary permissions to share them.
- 5.4 Pricing and Accessibility: Users who choose to sell study materials can set their own prices within a pricing range determined by Knoowpedia. There may be a minimum price requirement to maintain fair pricing across the platform. Additionally, users may choose to provide a limited preview of their content (such as a few pages) before purchase.
- 5.5 Knoowpedia’s Rights to Display and Convert Materials: By uploading content, users grant Knoowpedia a non-exclusive, worldwide, royalty-free license to display, distribute, and promote the materials on the platform. Knoowpedia may convert uploaded materials into different formats to optimize them for viewing, ensure compatibility, or improve user experience.
- 5.6 Advertisements in Study Materials: Knoowpedia reserves the right to insert advertisements into study materials through an automated process. These advertisements may appear within the document viewer or alongside the document page, depending on platform policies.
- 5.7 User Responsibility for Uploaded Content: Users retain ownership of their uploaded materials but are solely responsible for their content. Knoowpedia is not liable for any claims or disputes arising from the sale, distribution, or intellectual property issues related to user-uploaded content.
- 5.8 Indemnification: Users agree to indemnify and hold Knoowpedia harmless from any claims, damages, or legal actions resulting from the materials they upload. This includes any allegations of copyright infringement, violations of third-party rights, or any other legal disputes.
- 5.9 License Termination: Users may remove their uploaded materials from the platform at any time, at which point the granted license to Knoowpedia will be revoked. However, any materials already downloaded by other users will remain accessible to those users.
Article 6: Downloading Study Materials
- 6.1 Downloading Study Materials: Users can download study materials that are available either for free or for payment. A registered user profile is required to access downloads. The user profile will display a history of all downloaded materials, which remain accessible unless manually deleted by the user. If a user deletes a downloaded file, they will need to re-download it, provided it is still available on the platform.
- 6.2 Payment for Paid Study Materials: If a study material is offered for sale, users must complete the payment in full before access to the download is granted. Knoowpedia provides various payment methods as outlined on the platform. Further details regarding payment processing and security are covered in Article 7.
- 6.3 Reviewing and Rating Study Materials: Registered users have the option to review and rate the study materials they download. Reviews should be honest, relevant, and comply with Knoowpedia’s community guidelines.

6.4 Refund Policy: Refunds for purchased study materials will only be granted under the following conditions:
- The study material is not downloadable due to an error on the Knoowpedia platform.
- The downloaded file is demonstrably defective due to a platform-related issue.

6.5 Money-Back Guarantee: If a user is dissatisfied with their purchase, they may qualify for a refund under Knoowpedia’s "100% Money-Back Guarantee" policy, provided the following conditions are met:
- The purchase was made within the last 14 days.
- The user has contacted the seller to communicate their dissatisfaction and allow them to address any concerns.
- The refund request does not relate to missing content, missing chapters, or lack of information that was clearly stated in the seller’s description.
Article 7: Payment
- 7.1 Setting Prices and User Agreements: Users selling study materials can set their own prices, subject to a minimum threshold defined by Knoowpedia. By listing study materials for sale, the seller enters into a direct agreement with the buyer, granting them the right to access and use the content. Knoowpedia is not a party to this agreement but solely acts as a platform facilitating transactions.
- 7.2 Payment Processing: Payments for study materials are processed through third-party payment providers, as listed on the platform. Knoowpedia collaborates with these providers to ensure secure transactions, and earnings from sales are distributed accordingly among sellers.
- 7.3 Service Fees and Earnings Calculation: Knoowpedia deducts a service fee from each sale before disbursing payments to sellers. When uploading a study material and setting a price, users will see a real-time calculation of their estimated earnings after deductions.
- 7.4 Payment Records: Knoowpedia maintains transaction records for all users. In case of discrepancies, Knoowpedia's records will be considered accurate unless proven otherwise by the user.
- 7.5 Withdrawals and Minimum Balance: Sellers can withdraw their earnings at any time, provided they have a minimum balance of $15 (or equivalent in their local currency). Knoowpedia processes withdrawals on a daily basis. No interest is accrued on the balance held in user accounts.
- 7.6 Order Errors and Refund Policy: Knoowpedia does not accept liability for errors related to purchases, such as incorrect document selection or accidental orders. Purchases of study materials cannot be canceled or modified once completed. Users experiencing issues should contact the seller directly.
- 7.7 Tax Responsibility: Users are responsible for reporting and paying any applicable taxes on their earnings in accordance with the tax regulations of their country. Knoowpedia does not provide tax advice or handle tax payments on behalf of users.
- 7.8 Third-Party Payment Services: Payment transactions on Knoowpedia may be processed by PayPal or other third-party payment providers. By using Knoowpedia’s payment services, users agree to the PayPal User Agreement Terms and its Terms of Service. Users must provide accurate payment information and consent to Knoowpedia sharing necessary transaction details with Paypal or other payment providers.
Article 8: Copyright Violations & Complaints
- 8.1 Reporting Infringements: Knoowpedia is committed to protecting intellectual property rights. If you believe any study material infringes your rights, you may file a copyright infringement notice on our Contact Us page.

8.2 Required Information for Complaints: The complaint must include:
- The URL of the allegedly infringing study material.
- A statement explaining the infringement and why it violates your rights.
- Your contact details (full name, address, telephone number, and email).
- Documentary proof supporting your claim, including evidence of ownership.
- A clear description of the work(s) allegedly infringed, specifying the nature of the violation.

8.3 Review and Actions: Knoowpedia will assess the complaint and, if necessary, take action, which may include:
- Removing or restricting access to the disputed study material.
- Notifying the uploader about the claim and requesting a response.
- Forwarding the complaint to the user who uploaded the study material.

8.4 Right to Reject a Complaint: Knoowpedia reserves the right to deny takedown requests if:
- The provided evidence is insufficient or inaccurate.
- The study material is not clearly infringing any rights.
- A valid court ruling is required to determine infringement.
- 8.5 Liability and Indemnification: By submitting a copyright infringement notice, you agree to indemnify Knoowpedia against any claims from third parties regarding the removal of study materials. This includes legal costs and damages resulting from wrongful takedown requests.
- 8.6 Dispute Resolution: Knoowpedia remains neutral in disputes between content owners and uploaders. Any further legal action must be pursued directly between the affected parties.
Article 9: Platform Availability
- 9.1 Temporary Downtime: Knoowpedia reserves the right to temporarily disable or limit platform access without prior notice when necessary for maintenance, security updates, or technical improvements. Users are not entitled to compensation for any downtime.
- 9.2 Modifications & Updates: Knoowpedia may make technical or procedural changes to the platform without prior notice. These updates may include new features, security patches, or system optimizations.

9.3 No Guarantee of Uninterrupted Access: While Knoowpedia strives for high availability, we do not guarantee uninterrupted service. Temporary outages may occur due to:
- Internet or server disruptions.
- Technical failures, including software bugs or security threats.
- Third-party service downtime (e.g., payment providers).
Article 10: Intellectual Property Rights
- 10.1 Ownership of Intellectual Property: All intellectual property rights related to the platform, including website design, logos, and all content (except for study materials uploaded by users), are owned by Knoowpedia and/or its licensors.
- 10.2 Limited User License: Users are granted a personal, non-exclusive, non-transferable, and revocable right to access and use the platform solely in its intended format.
- 10.3 Restrictions on Use: Users may not alter, remove, or obscure any trademarks, copyright notices, or legal attributions found on the platform.
- 10.4 No Transfer of Rights: No part of these Terms and Conditions transfers any ownership of intellectual property to users. Users must refrain from any actions that infringe upon Knoowpedia's intellectual property, such as registering similar domain names or trademarks.
- 10.5 Prohibited Data Extraction: Users cannot systematically extract or reuse substantial parts of Knoowpedia’s content without prior written consent.
- 10.6 Use of Study Materials: Study materials are for educational purposes only. Uploading someone else’s work as your own is considered copyright infringement and academic misconduct.
Article 11: Liability
- 11.1 Limited Liability: Knoowpedia is not responsible for any damages resulting from the use of the platform beyond the scope outlined in this section.
- 11.2 Insurance Limitation: If Knoowpedia is liable for any damages, compensation is limited to the amount covered by its insurance. If no payout is made, other sections (11.3 - 11.5) apply.

11.3 Direct Damages Only:
Knoowpedia is only responsible for direct damages, including:
- Material damage to goods.
- Reasonable costs to prevent or mitigate further damage.
- Costs incurred to determine the cause and extent of damages.
- 11.4 No Liability for Indirect Damages: Knoowpedia is not responsible for loss of profits, data loss, business interruptions, or any indirect, incidental, or consequential damages.
- 11.5 Exceptions: Liability limitations do not apply in cases of Knoowpedia’s intentional misconduct or gross negligence.
- 11.6 Compliance with Academic Policies: Users are responsible for ensuring Knoowpedia's services comply with their university’s policies. Knoowpedia is not liable if the platform violates any institutional regulations.
Article 12: Force Majeure
- 12.1 Definition: If force majeure occurs, preventing Knoowpedia from fulfilling its obligations, the agreement is considered void without liability on either side.

12.2 Examples of Force Majeure:
Situations include, but are not limited to:
- Server outages or internet disruptions.
- Natural disasters, fires, floods.
- Strikes or absence of key personnel.
- Third-party failures affecting platform functionality.
Article 13: Termination
- 13.1 User-Initiated Termination: Users can terminate their account at any time by stopping platform use and deleting their profile.
- 13.2 Violation of Terms: Knoowpedia may suspend or delete a user’s profile if they violate these terms, especially articles 3, 4, or 5.
- 13.3 Outstanding Payments: Users with an account balance will receive their funds unless the account was terminated due to violations.
- 13.4 Inactivity Policy: Accounts inactive for 12 consecutive months are deemed "Inactive" and charged an inactive profile fee of $5 per month (or equivalent currency). Users can reactivate their account by logging in, which stops future fees.
Article 14: Governing Law & Jurisdiction
- 14.1 Legal Jurisdiction: These Terms and Conditions are governed by U.S. law.
- 14.2 Dispute Resolution: Any disputes will be settled exclusively in the District of Columbia, U.S.A., unless international law dictates otherwise.
Article 15: Miscellaneous
- 15.1 Validity of Terms: If any provision is deemed unenforceable, it will be adjusted while keeping the rest of the Terms valid.
- 15.2 Transfer of Rights: Knoowpedia may assign its rights to third parties. Users who disagree may terminate their profile.
